Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 German Civil Code) via the online shop of QUIRIS Healthcare GmbH & Co. KG, Isselhorster Str. 260, 33334 Gütersloh, Germany (hereinafter "QUIRIS", "we"). Sales to businesses (§ 14 German Civil Code) are not permitted; any orders from businesses may be rejected or canceled by us.

The purchase agreement is concluded with QUIRIS Healthcare GmbH & Co. KG.

3. Offer and conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. The essential characteristics of the goods are described in the respective product description in our online shop and form part of the contract. (2) By clicking the "order with obligation to pay" button (or a similarly clear wording), you submit a binding offer to conclude a purchase contract.
(3) Immediately after submitting your order, you will receive an order confirmation by email. This merely confirms receipt of the order and does not yet constitute acceptance.
(4) The contract is concluded when we accept the order by sending an order confirmation via e-mail or when we dispatch the goods.
4. Contract language, contract text storage
The language available for concluding the contract is German.
We save the contract text and send you the order details and these terms and conditions by email. If you have a customer account, you can view your orders there.
5. Prices and shipping costs
All prices include VAT.
We also charge shipping costs, which are specified during the ordering process.
6. Payment
The following payment methods are available: credit card, PayPal, Klarna, prepayment.
For payments made in advance, the invoice amount is due immediately; shipping takes place after receipt of payment.
When paying by credit card/PayPal/Klarna, the charge or debit will be processed depending on the payment method and provider during the order process.
7th delivery
(1) Delivery within Germany is usually made by DHL within 2-5 working days.
(2) Shipping to other EU countries is possible; delivery times may vary. The countries we currently ship to, as well as any areas excluded from delivery (e.g., island deliveries), are listed in the shipping information in our online shop. We cannot accept orders from other countries.
(3) If an ordered product is unavailable, we will inform you immediately. In this case, we will promptly refund any payments already made.
(4) In the case of consumers, the risk of accidental loss or accidental damage to the goods passes to you or to a recipient designated by you only upon delivery of the goods.
8. Retention of title
The goods remain our property until full payment is received.
9. Right of withdrawal
Consumers have a right of withdrawal in accordance with the following cancellation policy.
10. Warranty
The statutory warranty rights apply.
11. Liability
(1) We are liable without limitation for intent and gross negligence.
(2) We shall be liable without limitation for injury to life, body or health.
(3) Liability under the Product Liability Act and within the scope of a guarantee assumed by us remains unaffected.
(4) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the amount of the foreseeable, typical damage at the time of conclusion of the contract.
(5) Furthermore, liability for breaches of duty caused by slight negligence is excluded. Mandatory statutory liability provisions remain unaffected.
12. Set-off and right of retention
You are only entitled to offset your claims if your counterclaims have been legally established or are undisputed.
You can only exercise a right of retention if your counterclaim is based on the same contractual relationship.
13. Dispute Resolution
Notice pursuant to Section 36 VSBG: We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
The European Online Dispute Resolution (ODR) platform was discontinued on July 20, 2025; therefore, a link is no longer provided.
